Case on seizing USD 4 mln worth of assets of insolvent “VTB Bank” goes to court

The case on seizing UAH 96 mln worth of property of the insolvent “VTB Bank”, now in administration of the Individual Deposit Guarantee Fund, which has been exposed by the Security Service of Ukraine, is submitted to the court.

The fraud was organised by a director of a private company in cooperation with a private notary of Kyiv City Notary District. The notary produced fake purchase contracts for JSC “VTB Bank” property - two non-residence premises in Kharkiv and 23 apartments in a tower block located in Golosiivo region of the capital. On the basis of forged documents, the offenders managed to re-register ownership for 11 assets of the bank.

During the preliminary investigation, the actions of SBU and the Prosecutor General's Office No. 7 in Kyiv region helped to arrest all properties that were the subject of crime. The ownership of the properties has been returned to the Individual Deposit Guarantee Fund (assets of JSC “VTB Bank”).

Actions of the Director of the private company fall under Pt. 4 Art 190, Pt. 5 Art 27, Pt. 3 Art 358, Pt. 4 Art 358, Pt. 5 Art 27, Pt. 3 Art 365-2 of the Criminal Code of Ukraine (appropriation of property through deceit (fraud) committed in a large scale by a conspiracy). The actions of the notary classified as aiding in the preparation of forged document, committed deliberately, by a conspiracy, using deliberately forged official documents, aiding in the notary’s abuse of power, which caused grave consequences.

Currently the indictment sent to the Shevchenko District Court of Kyiv for consideration on the merits.

Sanctions under Part 4 of Art. 190 of the Criminal Code of Ukraine provide for punishment in the form of imprisonment for a term up to 12 years, with confiscation of property.
